Botany Bay Local Enviromental Plan

The Botany Bay Local Environmental Plan 2013 is a statutory planning document that sets the direction for growth in the City of Botany Bay.

The Botany Bay Local Environmental Plan 2013 was gazetted on 21 June 2013 and came into effect on 26 June 2013, repealing in part the former Botany Local Environmental Plan 1995.

The Botany Bay Local Environmental Plan 2013 applies to all land within the City of Botany Bay, except:

  • industrial lands covered by State Environmental Planning Policy (Three Ports) 2013, which relates to the Hales Street and Banksmeadow Industrial Precincts at Banksmeadow and provide specific planning controls for development within this area. 
  • 26 Tupia Street, Botany
  • 2, 4, 10, 12, 16 & 18 Macintosh Street & 862, 864,866 & 868 Botany Road, Mascot
  • Lot 6 DP.776212, corner of Wentworth Avenue & Dransfield Avenue, Mascot.

The BBLEP 2013 comprises of two parts:

Detailed planning controls supporting the Botany Bay Local Environmental Plan 2013 are contained within the Botany Bay Development Control Plan 2013.

Qantas Owned Land, Mascot

To introduce additional permitted uses relating to Sydney (Kingsford Smith) Airport on Qantas owned land at Mascot and to increase the FSR on Qantas owned IN1 zoned land to 1.5:1 for these purposes.

 4 Housekeeping Amendments
  •  The removal of Heritage Item I75 from heritage listing under Schedule 5 - Environmental Heritage and the associated heritage map.
  • The removal of the road widening from the LEP Land Acquistion Map over Part 53 DP.1097375.
  • Amend the Land Zoning Map so that the boundary of the IN1 zoning corresponds to the allotment boundary under DP.1187426.
  • Amend the Height of Building Map so that the boundary of the heights corresponds to the allotment boundary under DP.1187426.
  • Include in Schedule 1 - Additional Permitted Uses, depot and public administration building as permitted uses for the site known as 2 Hollingshed Street, Mascot.
  • Amend Schedule 1 - Additional Permitted Uses, to include recreation area as a permitted landuse for land known as Linear Park
  • Amend the FSR Map to show the 3:1 ratio for the site 284 Coward Street, Mascot.
